The petitioner is apprehending his arrest in a case registered for the offence punishable under sections 342, 354 and 379 of the Indian Penal Code.
Prosecution case is that the petitioner entered into the house of the informant and attempted to outrage her modesty. On alarm being raised, the petitioner took away jewellery wroth Rs.1,00,000/-.
It is submitted by the learned counsel for the petitioner that the accusation has been levelled maliciously as there was love affairs with the petitioner since long. Statement has been made in paragraph 3 of the application that the petitioner has no criminal antecedent. It appears that after investigation final report (charge sheet) has been
Patna High Court Cr.Misc. No.25625 of 2016 (2) dt.28-06-2016 submitted against the petitioner on 21.4.2016. Considering the nature of accusation against the petitioner, it is a fit case for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sheikhpura (Hathiyawan O.P.) P.S.Case No. 63/2016 pending in the court of Chief Judicial Magistrate, Sheikhpura. With the aforesaid observation, this application is disposed of.
