Smt. Sharda Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in P.R. No. 19 of 2018 arising out of Excise Case No. 163 of 2018 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that 18.960 liters of foreign liquor kept in plastic bag has been recovered from the back side of betel shop of this petitioner.
Counsel for the petitioner submits that petitioner is in custody since 8.10.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.71086 of 2018(2) dt.04-12-2018 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Muzaffarpur, in connection with P.R. No. 19 of 2018 arising out of Excise Case No. 163 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
Counsel for the State has appeared and submitted that petitioner has also been made accused in another Excise Case vide P.R. No. 5/18-19 arising out of Excise Case No. 92 of 2018. In such circumstances, petitioner will file affidavit at the time of furnishing bail bonds that he will not indulge in such type of activity in future, failing which, the bail bonds of the petitioner in the instant case will be liable to be cancelled.
