Petitioner seeks bail in Forbesganj P.S. Case No.19 of 2018 registered under Sections 379/411/427 of the Indian Penal Code.

The present case was registered for making an attempt to commit theft of money from ATM of State Bank of India situated in the house of Vijay Kumar Gupta.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the confession of one Raju Kumar Paswan recorded in connection with Fulkaha P.S. Case No.195 of 2018. Save and except confession of Raju Kumar Paswan that too in another case, the name of the petitioner surfaced in this case and only on the basis of confession, petitioner is in jail since

Patna High Court Cr.Misc. No.71963 of 2018(2) dt.10-12-2018 2/2 23.07.2018. Even the photographs from the CCTV Camera has not been obtained and there is absolutely no material against the petitioner.

Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Forbesganj P.S. Case No.19 of 2018.
