The petitioner seeks bail in Sheohar P. S. Case No. 111/18 instituted for the offence under Section(s) 341, 323 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

In the written report, there is allegation against this petitioner of causing fire arm injury to Navin Kumar below umbilicus region in the abdomen on account of which he fell down unconscious.

A supplementary affidavit has been filed in which the injury report of brother of the informant has been annexed as Annexure-2 to the supplementary affidavit, wherein, the doctor

Patna High Court Cr.Misc. No.71194 of 2018(2) dt.04-12-2018 2/2 has found lacerated wound in right flank of umbilicus level caused by fire arm. The doctor has opined the injury to be simple in nature.

This Court is of the view that injury caused by firearm in the umbilicus region is serious injury. Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of six months.

Petitioner may renew his prayer for bail after six months in the event trial is not concluded within aforesaid period.
