JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Secretary of Bhawanipur Primary Agricultural Co-operative Society (PACS) is apprehending arrest in a case registered for the offences punishable under sections 468 and 471 of the Indian Penal Code. It is alleged by the Chairman of Bhawanipur Primary Agricultural Co-operative Society (PACS) that the petitioner issued the proper receipt after realizing money from the prospective members by forged signature of the informant on the receipt.

It is submitted by learned counsel for the petitioner that the accusation has been levelled maliciously as the petitioner opposed the candidature of the informant during the last election of Bhawanipur Primary Agricultural Co-operative Society.

Patna High Court Cr.Misc. No.35385 of 2015 (2) dt.21-08-2015 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Adapur P.S. Case No.119 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
