JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This is an application for grant of anticipatory bail in connection with Marhowrah P.S. Case No. 390 of 2019 disclosing offences under Sections 341, 323, 307, 34 of IPC. Prosecution case is that accused persons including the petitioners while on the Bolero, chased the informant while he was going by Alto Car, they made indiscriminate firing on the informant and there is also allegation that the Alto car dashed the Belora and any how fled away.

Submission of the learned counsel for the petitioner is that as a matter of fact, there is election dispute between the parties as the grandfather of the petitioners, who was a candidate of M.L.A.. They have falsely been implicated in this case and having no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Saran, in connection with Marhowrah P.
