2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 149, 341, 323, 325, of the Indian Penal Code.

3. As per the prosecution case, the petitioner and other coaccused persons being eleven in number came and assaulted the husband of the Informant by means of deadly weapons due to which he sustained injuries and died during the course of treatment.

4. Learned counsel for the petitioner has submitted that it would be apparent from the FIR that the FIR was lodged against eleven accused persons including petitioner with general and omnibus allegation and no specific overt act has been attributed to the present petitioner. It is submitted that other similarly situated coaccused persons have already been granted the privilege of bail by

Patna High Court CR. MISC. No.51297 of 2025(4) dt.05-12-2025 2/2 co-ordinate benches of this Court vide order dated 08.05.2025 passed in Criminal Miscellaneous No. 65990 of 2024 and 01.05.2025 passed in Criminal Miscellaneous No. 23709 of 2025. It is further submitted that the petitioner has clean antecedent and is in custody since 04.06.2025.

Learned APP for the State opposed the grant of bail on the basis of allegations made in the first information report. 6.Taking into consideration the facts and circumstances and also considering the fact that there is no specific allegation against the petitioner coupled with the fact that other similarly situated co-accused persons have already been granted bail and chargesheet having already been submitted, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge, 3rd Naugachia in connection with Bihpur P.S. Case No. 157 of 2024.
