The petitioners seek bail in anticipation of their arrest in connection with Rahui P.S. Case No. 148 of 2021 instituted for the offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.

The petitioner No. 1 is said to have assaulted one Shivam, who is the brother of the informant, by means of

Patna High Court CR. MISC. No.63284 of 2021(2) dt.25-05-2022 2/3 butt of a pistol, which has cause only simple injuries to him. The petitioner No. 2 is said to have used an iron rod for assaulting one Vishwajeet, who too has received only simple injuries. Apart from the aforesaid two persons, nobody appears to have been injured from the side of the prosecution.

There is a counter version of the occurrence as well in which four persons have been injured including the wife of petitioner No. 1.

There appears to be a dispute between the parties over some issue and the allegations and the counter allegations have been overtly exaggerated.

Regard being had to the facts afore-stated, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif in connection with Rahui P.S. Case No. 148 of

Patna High Court CR. MISC. No.63284 of 2021(2) dt.25-05-2022 3/3 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
