====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 28-03-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.05.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that in the night of 24.05.2021, he was returning home on motorcycle of his brother as detailed in the F.I.R., when he was intercepted by two unknown criminals, they

The learned counsel for the petitioner submits that the F.I.R. was against unknown. The petitioner was apprehended based on suspicion and the police took his confession based on which, it is alleged that motorcycle, Aadhar card, mobile phone, passbook of the informant was recovered from the house of the petitioner. The learned counsel further submits that the petitioner is a person with clean antecedent and he was absolutely unaware that the co-accused has been arrested, had given him looted articles to keep.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and considering the fact that it is the first offence of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Muffasil P. S. Case No.85 of 2021, subject to condition that one of the bailors shall be the father of the petitioner namely, Md. Iliyas Ansari @
