2. The petitioner has preferred this application for grant of regular bail in connection with Bakhri P.S. Case No. 357 of 2024 dated 16.09.2024 registered for the offences punishable u/ss 115(2), 352, 351(2), 308(5) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, on 16.09.2024, the informant was sitting near Galla Arhat of one Binod Sah, suddenly the petitioner along with the co-accused, Rahul Kumar came and started abusing him. It is further alleged that the petitioner demanded rangdari of Rs. 5 lakh from the informant and on refusal, they assaulted him.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to land dispute. The petitioner has been made accused in this case merely on suspicion. The allegation of assault is general in nature and also no specific allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has ten criminal antecedents in which he is on bail in seven cases as stated in para 3 of the supplementary affidavit filed on behalf of the petitioner. The petitioner is in custody since 22.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the anticipatory bail application of the petitioner was earlier rejected by a Coordinate Bench of this court vide order dated 20.02.2025 passed in Cr. Misc. No. 7361/2025.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Bakhri P.S. Case No. 357 of 2024 with the condition :- (i) The petitioner is directed to remain physically present
