Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 34 of the Indian Penal Code. It is alleged that all the three petitioners assaulted the informant's brother namely Prem Nath Choudhary by lathi and stone as a result he received head injury and fell unconscious.
It is submitted by learned counsel for the petitioners that one lacerated injury of marginal size and other abrasion at left side of nose with bleeding were found. The C.T. Scan also suggest brain stem normal. It is further submitted that due to the dispute with regard to the money transaction
Patna High Court Cr.Misc. No.34287 of 2015 (2) dt.25-08-2015 2/2 the accusation has been levelled.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the accusation being not corroborated by the injury report, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri-on-Sone, Rohtas, in connection with Rohtas P.S. Case No. 65 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
