The petitioner who is in custody since 22.05.2019 has filed the instant application for grant of bail in connection with Matiyariya P.S. Case No. 21/2019 registered for the offence punishable under sections 353, 354, 354(A) of the Indian Penal Code.

As per the allegation in the FIR, the petitioner entered in the class room of the school where the informant was teaching and is said to have committed indecent act. It is submitted by learned counsel for the petitioner that the allegation as made in the FIR are false and concocted. The petitioner's younger sister happens to be a student of the said school and the petitioner is in custody since 22.05.2019.

Having heard learned counsel for the parties and taking into consideration the the facts of the case including the petitioner having no criminal antecedent and being in custody since 22.05.2019 the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Ist Class, Bettiah, West Champaran in connection with Matiyariya P.S. Case No.21/2019.
