The petitioners apprehend their arrest in Piprakothi P.S. Case No. 27/2015, registered for the offences punishable under Section 363, 366A of the Indian Penal Code.
The informant alleged that her sister Jagmala Devi and her husband Subal Das took her daughter to their home for one week, but her daughter did not return after one week. On enquiry Subal Das and Jagmala Devi disclosed that Harikamal Das kidnapped her daughter and they would bring her daughter back within one week. After one week Subal Das told that her daughter would not return.
The informant suspected that the petitioners helped
Patna High Court Cr.Misc. No.36641 of 2015 (3) dt.04-11-2015 2/2 Harikamal Das in kidnapping the victim girl.
It is submitted that the petitioners are villagers of Subal Das. They are not concerned with either Harikamal Das or brother-in-law of the informant. There is no material collected against the petitioner even during the course of investigation. Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Piprakothi P.S. Case No. 27/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
