The petitioner, being husband of the deceased, is languishing in jail custody since 29-04-2014 in a case registered under Sections-304(B)/34 of the Indian Penal Code. The dead body of the deceased was recovered and in course of investigation, no external injury was found on her person. Moreover, it is the case of the informant that in-laws of the deceased, including the petitioner, used to pressurize the deceased for fetching more dowry, and being fed up with the torture, she consumed poison but in course of investigation, except the informant, not a single prosecution witness stated about the alleged demand of dowry as well as torturing. It is obvious from perusal of paragraph-10 of the case

Patna High Court Cr.Misc. No.34163 of 2014 (3) dt.23-01-2015 2/2 diary that own sister of the informant, made statement before the police that having got information regarding the death of deceased, when she went to her in-laws house, she came to know that due to quarrel, the deceased consumed poison. Accordingly, the petitioner named-above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Araria P.S. Case No. 118 of 2013 to the satisfaction of Chief Judicial Magistrate, Araria.
