In the present case, petitioner is claiming for payment of Rs.1,61,591/- as he has supplied gas and welding materials which has been mentioned in the letter dated 16.9.1999. Certain payment has been made but he has not been paid Rs. 1,61,591/-.

Learned counsel for the Sugar Corporation has taken a plea that this writ petition suffers from delay and laches as well as he has claimed that record may not be available with

Patna High Court CWJC No.845 of 2017 (2) dt.01-11-2017 Corporation after such a long period so it is very difficult to find out the actuality of the outstanding dues. The present matter is too stale and same cannot be looked into by this Court.

Accordingly this writ petition is dismissed.
