The petitioner seeks bail in Sheohar P.S. Case No. 216 of 2018 instituted for the offence under Sections 63, 65 of Copyright 1957, Sections 103, 104 of Trade Marks Act, 1999 and Section 420 of Indian Penal Code.
It is alleged in the written report by Kumar Daya Shankar who was posted as Chief Enquiry Officer in Dabur India Limited that he has got information that one shopkeeper namely, Nawal Raut (petitioner) is doing business of duplicate Aawala oil. Thereafter, search was made in the shop of petitioner and huge quantity of Dabur Aawala oil has been recovered. It is further alleged that on enquiry test, the alleged Aawala oil was found to be duplicate.
Patna High Court Cr.Misc. No.70764 of 2018(2) dt.04-12-2018 2/2 Counsel for the petitioner submits that petitioner was bona fide shopkeeper. There is no any complaint made by the customer that he was selling duplicate Aawala oil. Counsel for the petitioner further submits that petitioner has clean antecedent. He is in custody since 27.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar, Distt. Sheohar, in connection with Sheohar P.S. Case No. 216 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
