The petitioner seeks bail in S.Tr.No. 63 of 2021, arising out of Bahadurganj P.S. Case No. 343 of 2020, registered for the offence under Section 395 of the Indian Penal Code. As per the F.I.R., some unknown miscreants committed dacoity in several houses including the house of the informant.

Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused. It is alleged that two mobile phones, one knife and cash of Rs. 3100/- were recovered from the possession of the petitioner. It is submitted that none of the recovered articles was looted one, rather they belong to petitioner himself. Till date, no T.I.P. has been held and petitioner is in custody since

Patna High Court CR. MISC. No.63228 of 2021(2) dt.18-02-2022 2/2 29.11.2020. Some of the similarly situated co-accused persons have already been granted bail by this Court. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge III Kishanganj / concerned court in connection with S.Tr.No. 63 of 2021, arising out of Bahadurganj P.S. Case No. 343 of 2020.
