The petitioner seeks regular bail in connection with Sadar P.S. Case No. 488 of 2018 arising out of CIS No. 795 of 2018, registered for the offence punishable under Sections 147, 148, 149, 332, 333, 336, 353, 307, 427, 290, 435 and 323/34 of the Indian Penal Code.
The allegation in the F.I.R. is regarding two persons having died in the road accident, whereafter the people from the village had assembled along with the dead body and were raising protest when the informant and other personnel came at the said place and thereafter, the informant and other personnel were assaulted by the crowd assembled at the
Patna High Court Cr.Misc. No.70551 of 2018(2) dt.12-12-2018 2/3 alleged place of occurrence. It is further alleged that about 29 named accused persons and 200 unknown persons had assembled there and created law and order situation. The learned counsel for the petitioner has submitted that no specific overt act has been alleged against the petitioner herein and the petitioner is having a clean antecedent. The petitioner is stated to be languishing in custody since 06.07.2018. Lastly, it is submitted that similarly situated co-accused persons have already been granted bail by this Court by an order dated 27.11.2018 passed in Criminal Miscellaneous No. 67861 of 2018 as well as vide order dated 29.11.2018 passed in Criminal Miscellaneous No. 68068 of 2018.
Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused persons have been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 488 of 2018 arising out
