ANJANA MISHRA ORAL ORDER 02-03-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 27.5.2014 in connection with Dhangai P.S. Case No.70 of 2013 registered for the offences under Sections 342, 323, 325, 307 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted on behalf of the petitioner that the main allegation of firing is against Manoj Rai and Dablu Rai whereas the petitioner is said to have fired at one Paras Nath Yadav. However, injury report, which has come, shows that all the injuries alleged to have been inflicted by the petitioner are simple in nature.

Considering the period of custody and also the fact that

No.34218 of 2014 (6) dt.02-03-2015 2/2 the petitioner's firing did not cause the death of deceased Jetan Yadav, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Dhangai P.S. Case No.70 of 2013.
