JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 13.07.2016 Learned counsel for the petitioners is permitted to delete the names of petitioner nos. 1, 2 and 3 within the course of the day. Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

It is submitted that petitioner- Sheikh Parwej and three others were granted privilege of anticipatory bail vide order dated 5.2.2015 passed in Cr. Misc. no. 5020/2015 in connection with Complaint case no. 1502C/2012 with direction to surrender before the Chief Judicial Magistrate, Bettiah, West Champaran within four weeks from the order dated 5.2.2015 but unfortunately, petitionerSheikh Parwej fell ill and he could not surrender before the court below within prescribed time and when he regained his health and after taking fitness certificate of the doctor, he went to the concerned court for surrender he came to know that the time granted by this court has already been lapsed. Therefore, it is prayed on behalf of the petitioner - Sheikh Parwej to extend some more time for surrender.

Patna High Court Cr.Misc. No.27335 of 2016 (2) dt.13-07-2016 Considering the aforesaid submissions as well as facts and circumstances of the case, let the petitioner surrender before the concerned court within four weeks from today and if the petitioner does so, the concerned court shall pass appropriate order in the light of order dated 5.2.2015 passed in Cr. Misc. no. 5020/2015. In the aforesaid manner, the above stated order dated 5.2.2015 passed in Cr.
