This application for grant of anticipatory bail arises out of Amjhor PS Case No. 78 of 2015, disclosing offences under Section 420, 409, 467 and 120B of the Indian Penal Code. The petitioner at the relevant point of time was working as Manager at Saraiya Branch of Sasaram-Bhabhua Central Co-operative Bank. It is alleged that the informant had deposited certain amount under Fixed Deposit account in the year 2011 and 2012. It is his allegation that subsequently the Bank has
Patna High Court Cr.Misc. No.36921 of 2015 (2) dt.10-09-2015 2/2 been found to be closed and the informant is not being given any information as regards the deposit which he made in the year 2011 and 2012.
In view of the nature of allegation, I am not inclined to grant the privilege of anticipatory bail as the petitioner's custodial interrogation may be required. This application is accordingly rejected.
The petitioner is directed to surrender before the court below within six weeks and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
