ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner seeks modification of the order dated 18.06.2015 passed in Cr. Misc. No. 18901 of 2015. Learned counsel for the petitioner submits that due to certain unforeseen circumstances, the petitioner could not arrange the money as stipulated in the order dated 18.06.2015 passed by this Court. He however, submits that he is willing to pay the same but some indulgence may be given so that he may be able to arrange the aforesaid money of Rs. 2,20,000/- (rupees two lacs and twenty thousand) and that installments may be fixed for making re-payment of the same.
Having considered the reasons stated in the modification application, the petitioner is directed to deposit the
Patna High Court Cr.Misc. No.27366 of 2016 (2) dt.20-08-2016 P2/3 entire amount of Rs. 2, 20, 000/- within a period of four months from today.
It is made clear that the said deposit shall be made in four equal installments and the first of the said installment shall be paid by the 5th of September, 2016. Thereafter, the petitioner shall deposit the rest amount within one month thereafter and similarly, the rest two installments shall also be paid by him by 20th October, 2016.
It is made clear that the entire amount should be deposited by the 5th of December, 2016. In case the entire amount is not deposited by 5th of December, 2016, the order granting him anticipatory bail shall automatically stand withdrawn. Till then, no coercive steps shall be taken against this petitioner in connection with Kotwali P.S. Case No. 271 of 2014 pending in the Court of learned Chief Judicial Magistrate, Munger.
After the petitioner deposits the entire amount, let the petitioner, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned in connection with Kotwali P.S. Case No. 271 of 2014 pending in the Court of learned Chief Judicial
Patna High Court Cr.Misc. No.27366 of 2016 (2) dt.20-08-2016 P3/3 Magistrate, Munger, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
With the aforementioned modification, the application stands disposed of.
