JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,325,307 and 504/34 of the Indian Penal Code. It is alleged that co accused Parmanand Yadav and Kapil Yadav caught hold of the father of the informant, thereafter petitioner no. 1 assaulted the father of the informant when the mother of the informant and Sunita Devi came to rescue then they were also assaulted by co accused Parmanand Yadav, Pankaj yadav and Chandan Yadav. It is alleged against petitioner no. 2 to have assaulted with bricks to the father of the informant causing fracture injury.

No.37568 of 2015 (2) dt.17-09-2015 2/2 It is submitted by the learned counsel for the petitioners that on completion of investigation the petitioners were not sent up for trial whereas others were chargesheeted but differing with the final form, cognizance has been taken on 24.1.2014. Statement to that effect has been made in paragraph 7 of the petition. It is further submitted that there is counter version of the occurrence also. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Rosera, Samastipur in connection with Bithan P.S. Case No.8 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
