The petitioner seeks regular bail in connection with Bisfi (Patauna) P.S.Case no.182 of 2018 and S.Tr. No.395 of 2018 registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code.

Allegation is of dowry death and the petitioner is said to be husband.

Submission of the learned counsel for the petitioner is that the independent witnesses of the village of the petitioner have stated before the police that there was always dispute between the petitioner and the deceased due to which she used to run away from the house and after pacifying she was sent back to her Sasural. On the day of occurrence, she hanged

Patna High Court Cr.Misc. No.71216 of 2018(3) dt.18-12-2018 2/2 herself and the dead boy was brought down by the villagers which will appear from para nos. 28, 29 and 30 of the case diary and it further appears that the petitioner was not there and the cause of death is also due to hanging.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ VIth, Madhubani in connection with Bisifi (Patauna) P.S.Case No.182 of 2018. With the aforesaid observation, this application is allowed.
