The petitioner is apprehending his arrest in connection with Madhepura P.S.Case No.220 of 2019 registered for offences punishable under Sections 18©, 27(b)(ii), 22(i)(coa) and 22(3) of the Drugs and Cosmetics Act, 1940. As per FIR there is recovery of 95 bottles of cough syrup from a bag kept in the motorcycle of the petitioner. The above syrup is scheduled and prohibited drug.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case at the instance of the informant and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of

Patna High Court CR. MISC. No.49132 of 2019(3) dt.24-10-2019 2/2 with direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below , if possible on the same day on the basis of the materials available on the record. With the aforesaid direction, this application is disposed of.
