====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-08-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 329(3), 329(4), 126(2), 115(2), 191(2), 191(3), 190, 109(1), 118(1), 103 of the Bharatiya Nyaya Sanhita.
3. According to F.I.R., on 14.03.25 at about 10:00 AM, all the F.I.R. named accused persons, including this petitioner, assaulted informant and his father by means of iron rod, lathi and tengari and during course of treatment, father of the informant succumbed to the injuries.
4. Learned counsel for the petitioner submits that from bare perusal of the F.I.R. it is apparent that petitioner is not the assailant of deceased. Petitioner is only alleged to have
Patna High Court CR. MISC. No.53877 of 2025(2) dt.18-08-2025 2/2 assaulted informant with Tengari but no injury report is annexed on record to support the said allegation. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-I, Jhanjharpur in connection with Khutauna P. S. Case No. 33 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
