Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 304(B), 201 and 34 of the Indian Penal Code, registered in connection with Noorsarai P.S.Case No. 161 of 2020.

As per allegation, the accused persons, named in the FIR, were making pressure on the deceased to fulfil their dowry demand of a motor-cycle. On 28.05.2020 at about 3.00 p.m., the informant got an information that the accused persons

Patna High Court CR. MISC. No.53671 of 2022(3) dt.08-02-2023 2/3 had committed murder of his daughter and concealed her deadbody. When he went to her matrimonial house, he came to know that the accused persons had forcibly administered her poisonous substance and committed her murder. The learned counsel for the petitioner has submitted that he is innocent and he is brother-in-law (Devar) of the deceased. He has no concern with day-to-day affairs of the couple and has falsely been implicated in this case merely because he is Devar of the deceased. He has submitted further that on similar ground mother-in-law of the deceased has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc. No. 21014 of 2022.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Noorsarai P.S.Case No. 161 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
