JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 19.01.2015 Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for informant.

Petitioner is named in the first information report but informant claimed in his fardbeyan to this extent that he had seen the petitioner and other FIR named accused persons fleeing from the place of occurrence.

Admittedly, having similar allegation co-accused Bishundeo Yadav and Ajit Kumar @ Ram Balak Yadav have already been granted privilege of bail by a coordinate bench of this court vide order dated 26.11.2013 passed in Cr. Misc. no. 23369/2013 and Cr. Misc. no. 31863/2013.

Learned counsel for the informant submits that prayer for bail of one co-accused Niranjan Yadav has already been rejected by a coordinate bench of this court vide order dated 15.07.2014 passed in

Patna High Court Cr.Misc. No.33909 of 2014 (3) dt.19-01-2015 Cr. Misc. no. 11962/2014.

Taking note of the aforesaid facts and circumstances as well as submissions of the parties and with a view to maintain parity of justice, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Pakribarawan P.S. Case no. 186/2012.
