The petitioner apprehends his arrest in Pirpainti P.S. Case No. 135/2014, registered for the offences punishable under Section 302, 201 and 34 of the Indian Penal Code. The mother of the deceased alleged that her daughter got married with Md. Elias, son of the petitioner Md. Mobarak. The daughter of the informant was at her home, but Md. Elias, Md. Gadan and Md. Nadeem @ Sonu came to her house on 12.06.2014 at 3.00 p.m. and took her daughter, but on the next day i.e., 13.06.2014, the dead body of her daughter was found lying in drainage.

The informant named nine persons including her son-inlaw and other family members, but the informant did not name the

The petitioner never subject the daughter-in-law to any sort of torture. During the course of investigation uncle and father of the deceased disclosed that the petitioner also might have conspired in killing of Najbin Khatoon, daughter of the informant. Except suspicion the police did not collect any tangible material. Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Pirpainti P.S. Case No. 135/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
