This application under Article 227 of the Constitution of India has been filed by the husband-petitioner praying for quashing Miscellaneous Case No.52 of 2016 filed by the respondent-wife for setting aside ex-parte judgment passed in Matrimonial Case No.153 of 2014 filed by the husband-petitioner under Section 13 of the Hindu Marriage Act.
In my opinion, the proceeding cannot be quashed under Article 227 of the Constitution of India, therefore, this civil miscellaneous application for the relief claimed is not maintainable. Accordingly, it is dismissed.
