JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Petitioner being husband of the victim is languishing in custody since 13.03.2014 in a case registered for the offences punishable under Sections 302/201 of the I.P.C.

It is alleged that daughter of the informant was killed by the petitioner after twenty years of marriage. The dead body of the victim was recovered from the road. It is submitted by learned counsel for the petitioner that postmortem does not reflect any injury and the viscera has been preserved. The report of the viscera has still not been received and the same has not been controverted by learned A.P.P after going through the case diary. It is submitted by learned A.P.P that minor child of the victim has stated that petitioner used to assault the victim.

Considering the fact that there is no eye witness to the occurrence and the postmortem does not reflect

No.29175 of 2014 (5) dt.10-02-2015 2/2 any injury, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Additional District Judge-I, Katihar in connection with Kadwa P.S. Case No. 48 of 2014, Sessions Trial No. 250 of 2014.

Let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during trial.
