JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner and learned counsel appearing for the State as well as learned counsel appearing for the informant.

Petitioner apprehends his arrest in a case under Sections 341, 323, 498A, 504/34 of Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The informant Rinku Kumari alleged that the petitioner and others accused persons tortured her for non-fulfillment of demand of dowry. She further alleged that the accused persons even tried to kill her.

Petitioner, who is the husband of the informant Rinku Kumari, submits that he has been falsely implicated in this case. In

Patna High Court Cr.Misc. No.25704 of 2016 (2) dt.05-07-2016 2/2 fact, the informant is arrogant in her behavior and does not want to reside with him.

In view of nature of allegations, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is refused with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice, preferably on the same day.

With the aforesaid observation, the anticipatory bail application filed by the petitioner is hereby dismissed (Samarendra Pratap Singh, J.) kunal/- U T
