The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that one truck loaded with hundred bags of rice was intercepted when the driver of the truck Ram Pravesh Rai admitted that he got the rice loaded from the house of Chairman of the PACS Sunil Kumar Sinha and the rice is being taken to the godown of this petitioner. It is submitted by learned counsel for the petitioner that except the admission of the driver there is nothing against the petitioner, moreover, the recovery cannot be treated

Patna High Court Cr.Misc. No.36952 of 2015 (2) dt.11-09-2015 2/2 from the possession of the petitioner.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 54 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
