In this case, the petitioner is seeking bail in connection with Dumraon (Naya Bhojpur) P.S. Case No. 79 of 2012 registered for offences under sections 7 and 8 of the E.C. Act.

As per the allegation, the Police found certain P.D.S. grain on the tractor which was being involved in loading and unloading, investigated the matter and submitted the final form in favour of the petitioner, but the court below has taken cognizance.

The counsel for the petitioner submits that the petitioner is a student of B.Tech at New Delhi and the day of the

Patna High Court Cr.Misc. No.26951 of 2016 (2) dt.05-07-2016 2/2 alleged occurrence he was not present in his native village. Looking to facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dumraon (Naya Bhojpur) P.S. Case No. 79 of 2012, subject to the condition as laid down under Section 438 (2) Cr. P.C.
