JUSTICE SHIVAJI PANDEY ORAL ORDER 27-03-2017 Heard learned counsel for the petitioner and learned counsel for the State.
In this case, the petitioner has taken loan of Rs. Seventeen lakhs (17,00,000/-) and she was required to deposit the E.M.I. of rupees 22,000/- per month for a period of 10 years but she has ignored to pay the amount as per the statement made in paragraph-4. The petitioner received the notice under Section 13(2) then she woke up from the slumber. As per the statement she has deposited an amount of Rs. 95,000/- on 02.1.2017. Again she has deposited Rs. One lakh on 13.2.2017 and Rs. 24,000/- on 06.3.2017. The petitioner submits that she is ready to liquidate all the outstanding dues inclusive of the interest and has filed an
Patna High Court CWJC No.3702 of 2017 (2) dt.27-03-2017 application before the Authorized Officer to regularize the E.M.I. and also to pay the rest outstanding dues. The said application has been filed on 27.2.2017.
Let the Authorised Officer should consider his decision in accordance with law. If the petitioner is ready to liquidate the outstanding dues and deposits the E.M.I. regularly without any fault, the Bank authority will act looking to the bona fide approach of the petitioner. But the moment petitioner fails to act as per her undertaking, the Bank will be at liberty to take legal course in accordance with law.
With the observations aforementioned, this application is disposed of.
