The petitioner has preferred this application for grant of regular bail in a case registered under section 302 of the Indian Penal Code.

As per the prosecution case, the son of the petitioner while returning home was shot from behind, as a result of which he died.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Chhotu Singh who has been enlarged on bail vide order dated 10.2.2022 passed in Cr. Misc no 38843 of 2021. Even as per the said confessional

Patna High Court CR. MISC. No.63049 of 2021(3) dt.13-05-2022 2/2 statement the petitioner is not the assailant of the deceased. The petitioner is in custody since 8.2.2021 and charge sheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, grant of bail to the above mentioned coaccused Chhotu Singh, the petitioner having remained in custody for more than 1 year and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Motipur P.S. Case no. 59 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-II, West, Muzaffarpur.
