The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 504, 506/34 of the Indian Penal Code and 25(1-B)a/26/27/35 of the Arms Act.
It is alleged that on the eve of Durgapuja three persons including the petitioner came and abused the members of the committee. Subsequently, co-accused Ranjan Kumar came and resorted to fire from his licensed pistol, but no injury was caused to anyone.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.36042 of 2015 (2) dt.21-08-2015 2/2 petitioner that accusation of firing is specific against co-accused Ranjan Kumar but no injury was caused to anyone. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Darbhanga in connection with Kamtaul P.S. Case No. 31 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
