Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Atri P.S. Case No. 455 of 2019 lodged under Sections 272, 273 of the I.P.C. read with Sections 30(a) (d), 37(2) of Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the total recovery of 10 litres of desi mahua wine has alleged to be made in this case. Learned counsel for the petitioner submits that nothing was recovered from his possession rather the said recovery was made from the possession of agricultural field of the cousin of the petitioner namely Manjit Kumar. Patna High Court CR. MISC. No.53285 of 2022(2) dt.21-10-2022 2/2 counsel for the petitioner submits that there is one criminal antecedent of the petitioner but it is not of excise matter. He submits that petitioner is in custody since 11.06.2022, charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Gaya in connection with Atri P.S. Case No. 455 of 2019, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
