1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant, Mr. Ashwani Kumar Tiwary.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 448, 376, 511, 307, 325 of the IPC in connection with Karakat P.S. Case No.146 of 2024.

3. The learned counsel appearing on behalf of the informant at the outset submits that he has instructions not to oppose the anticipatory bail application as the informant realizing her mistake has filed a compromise petition before the learned Trial court. It is also submitted that it is not a case of rape, but of attempt.

4. The learned counsel appearing on behalf of the petitioner also concurs with the submission made by the learned counsel appearing on behalf of the informant.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge, IIIrd, Rohtas at Sasaram in connection with Karakat P.S. Case No.146 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

6. The application stands allowed.
