====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barahiya P.S. Case No. 82 of 2018 instituted for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. In the written report it is alleged that father of informant had gone from his house to see his land and at about 12:30 p.m. he heard sound of firing. The informant went there and found his father lying dead. The informant has raised suspicion against this petitioner in the written report. Counsel for the petitioner submits that besides suspicion, there is no allegation of any overt act against the petitioner. Counsel for the petitioner further submits that coaccused Subhash Bind with similar allegation has already been granted bail by coordinate Bench of this Court vide order dated
Patna High Court Cr.Misc. No.70913 of 2018(2) dt.10-12-2018 2/2 20.11.2018 passed in Cr. Misc. 65438 of 2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P.S.
