JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in a case registered in connection with Kadwa P.S. Case No. 191 of 2021 for the offences punishable under Section 307/34, 386, 387, 120B/149 of the Indian Penal Code and section 25(1- b)a, 26, 27 and 35 of the Arms Act.
As per allegation in the F.I.R, while the informant was sitting in his office, two miscreants riding on Motorcycle came there and one of them fired on him but informant luckily escaped. Thereafter, they fled away.
Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused. No incriminating article
Patna High Court CR. MISC. No.63256 of 2021(4) dt.09-05-2022 2/2 has been recovered from the possession of the petitioner and till date the petitioner has not been put on Test Identification Parade. Petitioner claims clean antecedent and is in custody since 31.07.2021 and investigation in this case is complete. The learned A.P.P opposed the prayer for bail of the petitioner.
Having considered the aforesaid facts and material available on the record, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S.
