Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Forest Case No. 121/2016 registered for offence punishable under sections 33, 41, 42 of the Indian Forest Act, 1917 (Bihar Amendment 1989).

As per allegation, the police party intercepted a tractor loaded with stone chips. The driver of the tractor was arrested and he apprised the police party that the petitioner was the owner of that tractor.

No.63130 of 2021(2) dt.19-07-2022 2/2 The learned counsel for the petitioner has submitted that the name of the petitioner has figured in the confessional statement of co-accused. The real fact is that the petitioner is not the owner of that tractor and he is a person of clean antecedent. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas in connection with Forest Case No. 121/2016, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
