Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Khodawandpur P.S. Case No. 119 of 2020 registered for the offences punishable under Sections 120B, 364 and 365 of the Indian Penal Code.

As per the prosecution, the informant's brother namely, Sandeep was kidnapped.

No.53668 of 2022(4) dt.23-02-2023 2/3 The main submissions advanced by learned counsel Mr. Vinay Kumar Mishra, appearing for the petitioner are that the petitioner is not named in the FIR, his name surfaced in the alleged crime on the basis of statement of co-accused Panchu Kumar @ Dilip Kumar given before the police and the said coaccused has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No. 34855 of 2020 and the petitioner has criminal antecedent of eight cases in which he is on bail and moreover, the said cases are of different nature from the allegation made in the present matter. Further submission is that the so-called victim has been recovered and the informant has entered into compromise with the accused person which was mainly taken into account by a co-ordinate Bench of this Court while granting bail to co-accused Panchu Kumar @ Dilip Kumar.

Learned APP Mr. Shailendra Kumar Singh, appearing for the State has opposed the prayer for bail. In view of the facts, as stated above, the petitioner deserves to the privilege of bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection
