The petitioner apprehends his arrest in Narpatganj P.S. Case No. 421/2015, registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. The mother of the victim made allegation that her minor daughter did not return from her school. She made search and during course of search it transpired that petitioner and his family members kidnapped her daughter.

It is submitted that victim made her statement under Section 164 Cr.P.C. and she disclosed that she voluntary left her house and went along with the petitioner out of her free will and solemnized marriage. The victim denied the factum of her kidnapping.

No.34163 of 2016 (3) dt.17-10-2016 2/2 Considering the facts aforesaid and the fact that the victim herself disclosed that she left her house out of her free will and solemnized marriage voluntarily with the petitioner, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 421/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
