The petitioner seeks bail in anticipation of his arrest in connection with Sakra P.S. Case No. 295/19 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.

In view of the recovery of 881.280 litres of liquor from the fodder house of the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.10745 of 2021(2) dt.21-12-2021 2/2 Court below and seeks bail, that petition shall be considered on its own merits without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
