Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No. 361 of 2021 registered for offence punishable under sections 366 and 366(A) of the Indian Penal Code and section 3/ 4 of the POCSO Act.

The learned counsel for the petitioner has submitted that the victim, in her statement under section 164 of the Code of Criminal Procedure, has stated that she went with the petitioner with her own sweet will and solemnized marriage

Patna High Court CR. MISC. No.63137 of 2021(2) dt.19-07-2022 2/2 with the petitioner. Presently the alleged victim and the petitioner are living as husband and wife and the relation between the couple is cordial. Both the parties have compromised the case. The xerox copy of compromise petition is annexed with the record as Annexure-3.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special Judge (POCSO), Araria in connection with Forbesganj P.S. Case No.361 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
