Petitioner apprehends his arrest in connection with Sasaram (Model) P.S. Case No. 1001 of 2015 registered for the offence punishable under Sections420, 467, 468 and 471/34 of the Indian Penal Code.
The prosecution case, as lodged by the District Agriculture Officer, Rohtas, is that petitioner had submitted forged certificates for being appointed as Agriculture Advisor. It has been submitted by the learned counsel for the petitioner that petitioner has not yet been appointed on the basis of those alleged forged certificates and that he has no criminal history, as is evident from paragraph 3 of this application. Patna High Court Cr.Misc. No.33809 of 2016 (2) dt.24-08-2016 2/2 since been granted the privilege of anticipatory bail by a Coordinate Bench of this Court vide orders dated 08.12.2015 and 27.01.2016 passed in Cr. Misc. Nos. 55542 of 2015 and 3953 of 2016 respectively.
However, learned A.P.P. for the State submits that petitioner is named in the First Information Report and was seeking appointment on the basis of forged educational certificates, hence, opposes the prayer for bail. Be that as it may, since other similarly situated coaccused have been granted the privilege of anticipatory bail, let the petitioner, named above, in the event of his arrest or surrender before the learned Court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Model) P.S. Case No. 1001 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Nilu Agrawal, J.) Arjun/- U T
