The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A, 368, 120B/34 of the Indian Penal Code.

Accusation is of abducting the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that under Section 164 Cr.P.C. statement the victim got her age recorded 20 years, the Court also assessed her aged 20 years. She has also stated that she of her own married with the petitioner. Birth certificate of a child has been brought on record which suggests that out of wedlock a child was born. The parents have been granted bail vide Cr. Misc. No. 41983 of

Patna High Court Cr.Misc. No.37037 of 2015 (2) dt.14-09-2015 2013.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kursela P.S. Case No. 144 of 2011, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
