Petitioner, who is in custody, seeks bail in connection with Complaint Case No. 488 of 2016 registered for the offences punishable under Sections 498(A) of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Complainant has alleged that she has been tortured and ousted from her matrimonial house by the petitioner (husband) and other family members due to non-fulfillment of the demand of dowry.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.65006 of 2018(2) dt.05-11-2018 2/2 that he is innocent and has committed no offence. He has been falsely implicated in this case. Complainant was not happy with her marriage and was pressing the petitioner for divorce. No such occurrence ever took place. He has no criminal antecedent. He is in custody since 08.08.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Complaint Case No. 488 of 2016.
