JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-08-2019 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the respondent State. The issue raised in the present application is no more res integra. The similar matter was decided by this Court in C.W.J.C. No. 6139 of 2007 (Ram Ashish Tiwari & Ors Vs. State of Bihar) on 31.03.2013 and the L.P.A. preferred by the State against the decision of Single Judge was dismissed and the SLP preferred by the State was dismissed by the Apex Court. In view of the above, the present writ application is disposed of with a direction to the respondents to consider the case of the petitioner in light of judgement in Ram Ashish Tiwari (supra) and extend the same benefit to this petitioner also. Necessary decision be taken at the earliest preferably within a period of 60 days from the date of receipt/production of a copy of this order.

With the aforesaid, the present writ application stands disposed of.
